The owner of the online store modest.ee (hereinafter referred to as the Online Store) is NKLogistics OÜ (registration code 14810694), located at Vesivärava tn 50-201, 10152 Tallinn.
Validity of the Sales Contract, Information on Goods and Prices
The sales conditions apply to purchasing goods from the Online Store. The prices of the products sold in the Online Store are indicated next to the products.
The price includes a fee for the delivery of the goods. The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer at the time of placing the order.
Information about the goods is provided directly next to the goods in the Online Store.
Placing an Order
To order goods, you must add the desired products to the shopping cart. To place an order, you must fill in the required fields and choose a suitable method of delivery for the products. After that, the screen will display the amount of the fee, which can be paid via a bank link or another payment solution. The payment initiation service is provided by Montonio Finance UAB, registered in the Republic of Lithuania, registration code 3050205122, address Konstitucijos pr. 7, Vilnius, Lithuania.
The contract comes into force from the moment the sum payable is received into the Online Store’s settlement account.
If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be notified as soon as possible and the paid money (including delivery costs) will generally be refunded within 1-2 business days. Depending on the payment method, the receipt of the refund may take up to 7 business days.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania.
The buyer bears the shipping costs, and the relevant price information is displayed next to the shipping method. Domestic shipments in Estonia generally reach the designated destination within 2-4 business days from the enforcement of the sales contract.
In exceptional cases, the right exists to deliver the goods within up to 30 calendar days. If the Online Store has notified the buyer of delivery problems and a deadline exceeding 30 calendar days on the website or in the order confirmation, the deadline published by the Online Store applies.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To use the 14-day return right, the ordered goods must not be used in any way other than necessary to ascertain the nature, characteristics, and functioning of the goods in the manner permitted for testing the goods in a physical store.
If the goods have been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
To return the goods, a declaration of withdrawal from the purchase of the goods must be submitted, which can be found here, and sent to the email address info@modest.ee no later than 14 days after receiving the goods.
The buyer bears the cost of returning the goods, except in cases where the reason for return is due to the item being non-compliant with the order (e.g., wrong or defective item).
The buyer must return the goods within 14 days following the submission of the declaration or provide proof that he/she has handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the Online Store will immediately, but no later than 14 days after receiving the withdrawal declaration, refund all fees received from the buyer under the contract. The Online Store may refuse to make refunds until the item subject to the contract is received back or until the buyer has provided proof of returning the item, depending on which occurs first.
If the buyer has explicitly chosen a method of delivery different from the cheapest standard delivery method offered by the Online Store, the Online Store is not required to reimburse the cost that exceeds the expense related to the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store is marked significantly below the market price due to an error.
Right to File a Complaint
The Online Store is responsible for the non-compliance or defect of the goods sold to the buyer, which was present at the time of transfer and which becomes apparent within two years from the delivery of the goods to the buyer. For the first year after the transfer of the item to the buyer, it is presumed that the defect was present at the time of transfer. It is the Online Store’s obligation to refute this presumption.
In case of a defect, the buyer has the right to contact the Online Store within two months by sending an email to info@modest.ee or by calling +372 5034208.
The Online Store does not assume liability for defects arising after the delivery of the goods due to the buyer’s actions or inaction (improper use, accident, etc.) or for normal wear and tear from customary use.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods.
If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer.
The Online Store will respond to the consumer’s complaint in writing or in a format that allows written reproduction within 15 days.

Dispute Resolution
If the buyer has complaints regarding the Online Store, they should be sent to the email address info@modest.ee or by calling +372 5034208.
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer may refer the matter to the Consumer Disputes Committee. The conditions for the procedure can be reviewed and an application can be submitted here. The committee is competent to resolve disputes arising from a contract between the buyer and the Online Store. The examination of the buyer’s complaint by the commission is free of charge.
The buyer may turn to the European Union’s consumer dispute resolution platform.
